The principle: at-fault drivers are liable for damage

In NSW, the driver who caused the accident is generally responsible for the resulting vehicle damage. That right to recover your costs doesn't depend on you having comprehensive insurance — it depends on proving the other driver was at fault.

Step 1 — Gather your evidence

The stronger your evidence, the smoother the process. Collect:

  • Photos of both vehicles, the scene and the damage
  • The other driver's name, address, rego and insurer
  • Witness details and any police event number
  • A written, itemised repair quote

Step 2 — Get a proper repair quote

You can't recover a cost you can't prove. A vague figure won't cut it — you need a clear, itemised quote from a reputable repairer. We provide exactly that, broken down so the other party or their insurer can see it's fair.

Step 3 — Write a letter of demand

A letter of demand sets out what happened, that the other driver was at fault, and the amount you're claiming (your repair quote), with a reasonable deadline to pay. Many matters are resolved at this stage.

Step 4 — NCAT, if it comes to it

If they still won't pay, you can lodge a claim through the NSW Civil and Administrative Tribunal (NCAT) for motor vehicle property damage up to its limit. It's designed to be accessible without a lawyer.
